U.S. Senate Democratic Whip Dick Durbin, Ranking Member of the Senate Judiciary Committee, called on Mar. 25 for legislative action following a New Mexico jury's finding that Meta misled users about platform safety and enabled the sexual exploitation of young users.

The issue has drawn bipartisan concern as lawmakers debate how to address online child safety and hold social media companies accountable. The Senate Judiciary Committee, based in Washington, D.C., influences federal law and judicial matters across the nation according to the official website.

“There isn’t a parent or grandparent alive who isn't fearful of what the hell these kids are looking at all day long and what is happening to them as a result,” Durbin said during a committee hearing. He also said, “We have had lengthy hearings in this committee with the victims and families of victims of these practices. Promises by the industry to clean up their act and protect children [have led to] failure after failure.”

Durbin described the nearly $400 million civil verdict against Meta, Facebook, and Instagram as an indication that Section 230 protections for social media companies should be reconsidered. “This decision...is indication that Section 230 is not impregnable. That section has protected these social media vendors for a decade or more. It should be brought down,” he said.

He urged colleagues to move beyond repeated failed attempts at reform: “I bring this to the attention of the committee because this is one of the few issues where we universally agree on a bipartisan basis that we should act...This ought to be a call to action for this committee.”

The Senate Judiciary Committee affects constitutional protections and public safety nationwide via its legislative and oversight duties according to its official website. The committee aims to uphold the Constitution by reviewing legislation, overseeing federal law enforcement, evaluating judicial nominations, and influencing civil rights through its responsibilities according to information from its official site.

Durbin commended Raul Torres, Attorney General of New Mexico: “He points the way, and I think we ought to follow through.” He referenced recent hearings with social media company CEOs highlighting ongoing risks faced by children online.

Several bills championed by Durbin await further consideration in Congress—including bipartisan measures targeting child sexual abuse material online (STOP CSAM Act), regulation on nonconsensual explicit images (DEFIANCE Act), and legislation proposing repeal of Section 230 (Sunset Section 230 Act). The Senate Judiciary Committee serves as a standing body with authority over judicial matters according to its official website.
