Cesar Gonzalez Falcon, a 41-year-old Mexican national unlawfully residing in Tahlequah, Oklahoma, was sentenced to time served for illegally possessing a firearm and ammunition, according to an April 9 announcement from the United States Attorney’s Office for the Eastern District of Oklahoma.
The sentencing underscores ongoing efforts by federal authorities to address firearms violations involving individuals without legal status in the United States.
Gonzalez Falcon pleaded guilty on August 26, 2025, to one count of being an illegal alien in possession of a firearm and ammunition. Investigators reported that on May 12, 2025, he knowingly possessed a 12-gauge pump action shotgun and four rounds of ammunition while aware of his unlawful status in the country. The investigation involved multiple agencies including the U.S. Department of Homeland Security’s Immigration and Customs Enforcement Division, the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Cherokee County Sheriff’s Office.
The case is part of Operation Take Back America—a nationwide initiative by the Department of Justice aimed at addressing illegal immigration issues as well as targeting cartels and transnational criminal organizations.
Senior Judge Ronald A. White presided over the hearing at the United States District Court for the Eastern District of Oklahoma. After sentencing, Gonzalez Falcon was remanded into custody pending resolution of an Immigration and Customs Enforcement detainer. Assistant U.S. Attorney Jonathan E. Soverly represented federal prosecutors during these proceedings.
