Alexander Justin McAfee, a 34-year-old resident of Tampa, has been indicted on two counts of interstate communication of a threat to injure, according to an April 16 announcement by U.S. Attorney Gregory W. Kehoe. If convicted, McAfee could face up to five years in federal prison for each count.
The indictment states that on April 8, McAfee published a video in which he threatened FBI Director Kash Patel. The following day, he released another video threatening Secretary of War Pete Hegseth. These allegations were presented during court proceedings.
McAfee made his initial appearance in federal court on April 17 and is currently detained pending trial. The charges against him are formal accusations and do not constitute proof of guilt; every defendant is presumed innocent unless and until proven guilty.
The case was investigated by the Federal Bureau of Investigation, the Tampa Police Department, and the Hillsborough County Sheriff’s Office with support from the Capitol Police and the United States Secret Service. Assistant United States Attorney Muriel Moore will prosecute the case.
