Emilio Garcia-Cappas, a 29-year-old from Springfield, Massachusetts, pleaded guilty on April 17 to charges of distributing and conspiring to distribute fentanyl. U.S. District Court Judge Mark G. Mastroianni set sentencing for July 29.
Garcia-Cappas admitted guilt to one count of conspiracy to distribute and possess with intent to distribute fentanyl, as well as one count of distribution of and possession with intent to distribute fentanyl. The defendant was indicted by a federal grand jury in April 2024.
According to court records, Garcia-Cappas conspired between February 5 and February 22, 2024, to distribute fentanyl. On February 12, he distributed and possessed the drug with intent for further distribution. Undercover law enforcement officers purchased fentanyl from Garcia-Cappas and his co-conspirators on three occasions.
The maximum sentence for each charge is up to thirty years in prison, at least six years of supervised release, and a fine up to $2 million. Sentences are determined by a federal district court judge according to the United States Sentencing Guidelines and relevant statutes.
