DOL administrative judge orders federal contractor to turn over documents as part of federal compliance audit

A judge with the U.S. Department of Labor (DOL) has ordered a federal contractor to hand over documents as part of a federal compliance audit.

The organization in question is Cincinnati, Ohio-based Convergys Customer Management Group Inc.

“The judge found that OFCCP’s request for the affirmative action programs and supporting data did not violate the Convergys’ Fourth Amendment right against unreasonable search and seizure or Fifth Amendment right to due process,” DOL said in a news release.

The news release reported that in the past, Convergys did not provide documents related to the company and its affirmative action programs, along with several other supporting documents to the Office of Federal Contract Compliance Programs.

“Convergys Customer Management Group Inc. is in the market of outsourced telephone marketing, research and databases to communication, health care, travel and retail businesses worldwide,” according to the DOL.

The company had multiple contracts with the federal government throughout the country and if they do not adhere to the judge’s orders, “its government contracts will be terminated immediately,” according to a news release.

Judge Theodore W. Annos dismissed Convergys’ counterclaim that the Fourth Amendment protected the company from submitting the documents in question because they were a federal contractor and ordered the company to turn over the documents within 30 days.
