ATLANTA, Ga. - The U.S. Department of Transportation’s Federal Aviation Administration (FAA) is proposing a $90,000 civil penalty against Pearl Paint North America of Harvey, Ill., for allegedly violating Hazardous Materials Regulations.
The FAA alleges that on Feb. 7, 2013, Pearl Paint offered UPS a 5-gallon metal container of flammable paint for transportation by air to Shelby, N.C. Workers at the UPS sort facility in Louisville, Ky., discovered the shipment.
Investigators determined the shipment was not accompanied by shipping papers to indicate the hazardous nature of its contents. The FAA also alleges the boxes were not marked, labeled or packaged in accordance with the Hazardous Materials Regulations. Pearl Paint also offered the shipment without providing emergency response information, the FAA alleges.
Pearl Paint is scheduled to meet with the FAA in late February to discuss the case.
