U.S. Department of Education releases new resources for addressing sex discrimination under updated Title IX

The U.S. Department of Education’s Office for Civil Rights (OCR) has released two new resources to assist schools in complying with the 2024 amendments to Title IX Regulations, which became effective on August 1, 2024. These resources aim to clarify and update obligations related to Title IX coordinator duties and prohibitions on sex discrimination based on pregnancy or related conditions, as well as parental, family, or marital status.

The first resource, "2024 Title IX Regulations: Impact on Title IX Coordinator Duties," outlines new and updated requirements for Title IX coordinators. It addresses questions such as:

- What training must be provided to a Title IX coordinator?

- What steps must a Title IX coordinator take in response to notice of possible sex discrimination?

- What actions must a Title IX coordinator take concerning students who are pregnant or experiencing pregnancy-related conditions?

The second resource, "2024 Title IX Regulations: Nondiscrimination Based on Pregnancy or Related Conditions & Parental, Family, or Marital Status," clarifies prohibitions on sex discrimination for students, employees, and applicants for admission or employment. It answers questions including:

- What does “pregnancy or related conditions” include? How does Title IX apply to “parental status”?

- How can a student obtain pregnancy-related reasonable modifications, leave reinstatement, and access to a lactation space?

- What type of lactation time and space must a school provide for employees?

These new resources complement previously released technical assistance documents aimed at implementing the 2024 Title IX Regulations. These include summaries of major provisions; guidance for drafting nondiscrimination policies; notices of nondiscrimination; grievance procedures; implementation pointers; and a small entity compliance guide.

As of August 28, 2024, the Department is enjoined from enforcing the 2024 Final Rule in several states due to federal court orders. The affected states include Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska North Dakota Ohio Oklahoma South Carolina South Dakota Tennessee Texas Utah Virginia West Virginia Wyoming Additionally enforcement is also halted at specific schools listed online This list may be updated per future court orders In these states and schools the Department's amended 2020 Final Rule remains in effect
