Auto emissions firm Faurecia agrees to pay $101K over overtime violations

Faurecia Emissions Control Technologies USA Inc., a vehicle exhaust systems manufacturer based in Auburn Hills, Michigan, has agreed to pay $101,527 to 260 employees for overtime wage violations. The payment includes $50,563 in back wages and an equal amount in liquidated damages.

An investigation by the U.S. Department of Labor's Wage and Hour Division revealed that Faurecia Clean Mobility failed to comply with federal law by not including hourly shift differentials into employees' regular rate of pay when calculating overtime. Additionally, the company did not maintain accurate payroll records or display federal labor posters as required.

"When employers calculate an employee’s hourly rate for the purposes of overtime, they must include shift differentials and non-discretionary bonuses into that calculation," stated Aaron Loomis, Wage and Hour District Director in Indianapolis. "Employers or workers with questions on how to accurately calculate wages due should contact the Wage and Hour Division for compliance assistance."

The division provides resources such as the Workers Owed Wages search tool for those who believe they are owed back wages. Confidential compliance assistance is available through a toll-free helpline at 866-4US-WAGE (487-9243). The EMPLEO alliance also offers support to Spanish-speaking employees and employers about workplace rights.

Additionally, a new Timesheet App for iOS and Android devices has been launched by the agency to help ensure hours worked and pay received are correct.
