DHS extends temporary protected status for Ukrainians amid ongoing conflict

The Department of Homeland Security (DHS) has announced an 18-month extension of Temporary Protected Status (TPS) for Ukraine. This decision is based on ongoing armed conflict and extraordinary conditions in Ukraine that make it unsafe for eligible Ukrainian nationals to return.

The extension was determined after a review of the situation in Ukraine and consultations with interagency partners. The current circumstances stem from the Russian military's expanded invasion, which is noted as the largest conventional military action in Europe since World War II. This invasion has resulted in numerous civilian casualties, reports of war crimes, and a humanitarian crisis, leaving many Ukrainians without essential services like electricity and medical care.

Approximately 103,700 current TPS beneficiaries are affected by this extension. These individuals can re-register for TPS if they continue to meet eligibility requirements. Re-registration applies only to those who have previously registered under Ukraine’s designation and have resided continuously in the United States since at least August 16, 2023.

The DHS emphasizes rigorous national security and public safety vetting during both initial application and re-registration processes. Individuals posing a threat may face detention or removal. Those convicted of any felony or two misdemeanors are barred from receiving TPS.

Recognizing potential delays in Employment Authorization Document (EAD) issuance, DHS is automatically extending the validity of EADs issued under Ukraine’s TPS designation by 12 months.

U.S. Citizenship and Immigration Services (USCIS) will continue processing pending applications related to Ukraine's TPS designation. Applicants with pending Form I-821 or Form I-765 do not need to file again; approved applications will grant TPS through October 19, 2026, with corresponding EADs valid through the same date.
