Today, Education and Labor Committee Republican Leader Virginia Foxx (R-NC) issued the following statement after a Texas federal judge overturned a Department of Labor (DOL) final rule that rescinded a Trump-era rule clarifying the classification of workers under the Fair Labor Standards Act (FLSA):
“Independent contractors are an important part of the American workforce, ensuring that the U.S. economy remains an engine of opportunity, growth, and prosperity. Workers who want the freedom and flexibility to support themselves and their families should not be denied the opportunity to set their own hours and pursue economic opportunities.
“The Biden administration’s DOL tried to silence American voices when it hastily withdrew a Trump-era rule that provided clarity to workers and businesses under the FLSA. The Trump-era rule prioritized and respected independent contractors’ desire for entrepreneurial opportunities. More than 19 million Americans choose to be their own boss; it is gratifying to see our legal system protecting this right."
