The House Committee on Oversight and Government Reform, led by Chairman James Comer (R-Ky.), has scheduled a markup session for Wednesday, January 21, 2026. The committee will consider two resolutions recommending that former President Bill Clinton and former Secretary of State Hillary Clinton be held in contempt of Congress for not complying with subpoenas.
Chairman Comer stated, “Bipartisan subpoenas issued to the Clintons are not suggestions. They are legally required to appear before the House Oversight Committee, yet they have defiantly delayed and denied their legal obligations. The Clintons are not above the law, and the House Oversight Committee will move to hold them in contempt of Congress. As Ranking Member Garcia has stated, ‘defying a congressional subpoena is highly illegal’ and ‘no one is above the law.’ If Democrats refuse to hold the Clintons accountable, they will expose themselves as hypocrites.”
The markup is set for 10:00 a.m. ET at HVC-210 in the U.S. Capitol Visitors Center and will be livestreamed online. Media representatives are asked to RSVP by Tuesday, January 20 at noon.
On July 23, 2025, both Republicans and Democrats on the Federal Law Enforcement Subcommittee unanimously approved issuing subpoenas to ten individuals—including Bill and Hillary Clinton—for testimony related to crimes committed by Jeffrey Epstein and Ghislaine Maxwell. Following this vote, Chairman Comer formally issued subpoenas on August 5, 2025.
Bill Clinton was initially requested to appear for a deposition on October 14, 2025; this date was moved to December 17 after he cited funeral attendance as a conflict. The committee offered further accommodation if alternative dates were proposed for January but received no response from Clinton. A new subpoena set his deposition for January 13, 2026; he did not appear.
Hillary Clinton’s deposition followed a similar timeline: originally scheduled for October 9, rescheduled to December 18 due to funeral attendance conflicts. She also declined to propose alternative dates in January when prompted by the committee. A new subpoena set her deposition for January 14, but she did not attend.
Video statements from Chairman Comer following Bill Clinton’s absence and footage from both depositions have been made available by the committee.
